Terms & Conditions for Listing Your Names In the Atom Marketplace

The Atom Domain Marketplace allows you to sell your names to potential customers. Read more about how it works here. 

These Terms and Conditions apply to You (the seller) and Atom. 

General Terms & Conditions

  • Atom reserves the right to approve or deny your Marketplace submissions.

  • Until the Domain Transfer is complete, the customers have the ability to cancel their purchase. In that case, the customer's payment will be refunded and you will not receive any compensation. The domain name will be re-listed for sale in the Marketplace. 

  • As long as the domain has not been sold to a customer, you are allowed to submit that name in other contests hosted on Atom.com

  • Your account must be active and in good standing at the time of domain sale in order for you to receive the compensation. 

  • Atom may design Logos or custom images to promote some of your domains in our Marketplace. Any such Logos or custom images are exclusive property of Atom and can not be reproduced or displayed on third party websites without written permission of Atom.

  • We do not allow domains that imply hate speech often express intolerance, discrimination, or hostility towards individuals or groups based on characteristics such as race, religion, gender, sexual orientation, nationality, disability, or other personal attributes.

  • Cybersquatting (domain squatting) names that are directly targeting a known trademark. Names that are similar to a legitimate entity's name, such as a business, organization, or individual are not allowed.

Commission Structure & Pricing

  • For Premium Listings, the typical commission charged by Atom ranges from 15% to 30%, depending upon the final selling price. Check this page for more details on Commissions and other Benefits. (Please ensure you are logged into your Atom Account to view this page)

  • For Standard Listings, sellers pay a fixed commission of 7.5%. Sellers can also opt for additional marketing exposure on Standard listings for increased commission, or a small upfront fee.

  • For Ultra Premium Domains, there is a 15% standard commission, however, a custom commission may be set for some ultra premium domains, which will be communicated with the seller upfront. The listing will be published upon acceptance of the commission by the seller.

  • For Atom-Registered Domains, the typical commission offered to sellers is 25% of the selling price (during the first year). Atom covers the cost of domain registration and ongoing renewal fees for Atom-registered domains. However, Atom reserves the right to not renew domains at its discretion.

  • Your final commission will be based upon the actual selling price of the domain. The commission will be deposited to your account after the domain has been successfully transferred to the buyer. For example, if the commission rule is Atom Receives 30% and the domain sells for $3000, you will receive $2100 Net proceeds after it is transferred to the buyer. 

  • Atom has partnerships with third party agencies and selling platforms to promote and sell your domains. If a buyer purchases the domain via these third party platforms, they may incur an additional markup to cover the cost of commission by these platforms.

Submitting marketplace domains into contests 

  • You may submit your Premium Domains to contests that allow such submissions. You may also submit Standard Listings to contests if they have the Marketing Exposure enabled.

  • If the marketplace domain is purchased by the contest holder, you will receive the greater of the contest award amount or the domain payout (minus Atom commission) as per the selling price of the domain. 

Domain Transfers

  • Once a domain has been purchased, you agree to transfer the domain promptly to Atom's holding account in the same registrar, or by providing an Authorization Code (in case of a different registrar). Atom team will work with the buyer to assist them in transferring the domain to their ownership.

  • If Atom team is not able to receive transfer instructions from the buyer within 5 business days, you may be asked to transfer the domain to Atom's ownership so that you can receive the payment for the purchase price of the domain (minus any applicable commissions)

  • Once you have received the payment for the purchase price of the domain (minus any applicable commissions), you no longer have any rights to the domain.

Atom Registered Domains - Terms & Conditions

  • Atom offers sellers the opportunity to propose unregistered domain ideas, with Atom covering the registration fees and ongoing renewals. If your submission is approved for the Marketplace, Atom will deduct 100 points from your account.

    Upon registration of the domain, Atom will become the owner of record, which means that the domain cannot be listed for sale on other platforms outside the Atom.com Marketplace.

  • Renewals: Atom registers each approved domain for one year. After this period, Atom may choose to renew the domain at its discretion. If renewed, Atom will continue to cover renewal costs, but this may result in a reduced seller commission. Sellers wishing to maintain the original commission rate can opt to pay a fee of $10 (or $5 plus 500 points) to retain the higher commission for an additional year. These commission terms may vary depending on the specific domain, and details will be displayed before you select a renewal option.

  • If Atom decides not to renew a domain, it may drop the domain or choose to include the domain in a Domain Auction. In such cases, the domain ownership will transfer to the auction winner upon payment completion, and the original seller will receive a commission based on the active commission rule and final sale price.

  • Atom retains full control over pricing and discounts for Atom-owned domains, adjusting prices as needed based on market conditions.

Seller Owned Domains Terms & Conditions (Premium Listings)

  • If your listing is approved, you would need to point your domains to the Atom Name Servers (i.e. these domains will be listed exclusively on Atom)

  • In case of Seller-owned domains, you have the option to submit domains with or without Atom coins. You receive additional benefits with Atom coins such as faster review times, partial exclusivity, and better commission rates. However, if your domains are not approved, the coins are not refundable.

  • In case of Seller-owned domains, Atom has limited control over lowering the selling price or offering a discount once the listing has been approved by the seller. Atom will not reduce the approved selling price by more than $200 (unless that reduction is explicitly approved by the seller). 

  • You can remove your listing at any time by giving us a 30-day notice

  • If the domain received an offer or inquiry within the last 30 days, you must wait 30 days before requesting a removal of the listing.

  • Excessive or Frequent removal of listings will likely reduce your ability to submit domains in the future because Atom makes upfront investment in creating logos and promoting the domains.

  • Atom may notify you regarding any offers or inquiries received on the domain. You are under no obligation to accept an offer below the BIN price. Raising the BIN price immediately after an inquiry or offer is received is not allowed. If you raise the BIN price within 7 days of receiving an inquiry or offer, you must notify the Atom team and provide at least a 72-hour window to allow the buyer to complete the purchase at the original BIN price.

  • If you remove the listing, you do not own any rights to the logo created by the Atom team.

  • Selling any of your premium listings outside Atom platform while your listing is active at Atom is a direct violation of our Terms of Service. 

Seller Owned Domains Terms & Conditions (Standard Listings)

  • You are not required to point your Standard Listings to Atom Name Servers but you must verify the ownership of the domains (either by adding Name Servers or TXT records)

  • You have full flexibility in setting pricing for Standard Listings

  • Standard Listings do not require any exclusivity. You are allowed to list Standard Listings on any other platforms

  • Negotiating with a buyer on Atom platform and completing the sale outside Atom is not allowed. If the Transaction requires the use of a third party Escrow service, Atom can assist with setting up such a transaction

  • If you no longer own the Standard Listing, or if it sells outside Atom platform, you must delist the domain from your Atom account to ensure it is no longer offered for sale.
