Renting a Domain - Terms for Renters

You agree to pay a recurring monthly rental fee, as listed on the domain listing page, for as long as the rental remains active. The fee includes Atom’s rental servicing and other platform fees. You are separately responsible for the domain's registration renewal fees that come due during the rental period, these are in addition to your monthly rental fee.

The monthly rental fee will increase by 5% on each annual anniversary of the rental start date.

Your credit card will be automatically billed in advance on the monthly due date. An active automatic payment method is required for the duration of the rental. If we are unable to bill your card, you have 10 days to provide another payment method.

After your first payment, most domains will be added to your Atom account, where you can update the name servers and make changes immediately. For domains that are not added directly to Atom, you can manage them through the Transfer Center. You can always contact us via email or chat for support, we typically respond within 1–2 business days. You receive DNS / nameserver management access only, which does not grant you any ownership interest in the domain.

During the rental, the domain will be held by Atom in an Atom-managed registrar account, and will be removed from the marketplace and marked as unavailable for the duration of the rental.

You hold usage rights only. You may not sell, assign, transfer, pledge, encumber, license, sublicense, lease, sublease, release, or otherwise grant any third party any rights in the domain. Any attempted transfer in violation of this is null and void and is a material breach of these terms.

You may not market, advertise, or represent the domain as available for sale, transfer, or licensing during the rental, on Atom’s platform or any other domain marketplace or registrar.

Monthly rental fees apply for as long as the rental stays active and aren't reduced or offset for issues affecting the domain. You can cancel at any time, and while fees already paid are non-refundable, Atom will work with you in good faith if an issue arises.

While the rental is active and in good standing, you receive exclusive usage rights to the domain, the domain is removed from the marketplace, and the domain owner may not sell the domain to any other party.

Your purchase price (the "Purchase Unlock Price") is locked at the domain's BIN price as of the date the rental begins and remains valid until the domain is purchased or the rental is terminated, whichever comes first. The Purchase Unlock Price will not increase during the rental.

The Renter may choose to purchase the domain at any time while the rental is active; purchase is an option and not an automatic outcome of the rental. Once the purchase is completed, Atom will ensure full control and ownership of the domain is transferred to the Renter.

Rental payments are not credited toward the purchase price and do not reduce the Purchase Unlock Price.

If you purchase the domain, Atom’s standard marketplace commission and transaction terms apply, as with any other marketplace purchase.

Rental fees are billed in advance. If we are unable to bill your card on the due date, you have 10 days to provide another payment method.

If payment remains outstanding beyond 10 days of the due date, Atom will suspend the domain’s DNS and terminate the rental.

As a Renter, you also have the option to request cancellation of the rental at any time. To request cancellation, you must notify Atom at least 48 hours before the next rental payment due date. Once a rental has been cancelled, Atom will no longer bill you for any future payments. Please send an email to service@atom.com to request cancellation.

In the case of automatic termination or Renter-requested cancellation, your exclusive usage rights end, the domain will be re-listed for sale on the Atom marketplace, and any custom DNS settings previously requested by the Renter will be removed.

Rental payments are non-refundable under any circumstances.

If, after the Renter’s first payment, Atom is unable to place the domain in an Atom-managed registrar account within 5 business days, the Renter will be entitled to a full refund of their initial payment, and the rental will be cancelled.

Atom may require additional identity, payment, or transaction verification before completing any transaction, and may delay or withhold access to the domain pending completion of such verification.

If any payment is reversed, charged back, or determined to be unauthorized, Atom may suspend the rental, recover the domain, offset such amounts against any funds held, and pursue any remedies available at law or in equity.

Atom may offset any amounts you owe against any payments, refunds, or credits otherwise due to you in connection with this or any other transaction.

During the rental, the domain may not be used for any unlawful purpose or in connection with spam, phishing, fraud, or other deceptive or abusive practices. Any such use may result in immediate termination of the rental and suspension of the domain’s DNS.

You are solely responsible for the content and services hosted on the domain. Atom and the domain owner are not liable for the Renter’s content or use of the domain. You may not use the domain in any manner that infringes a trademark or other intellectual property rights, constitutes bad-faith registration or use under applicable domain dispute policies (including the UDRP or URS), or is reasonably likely to subject the domain to a claim.

Certain categories of use, such as gambling or adult content, may be permitted provided they are lawful in all applicable jurisdictions. Because such uses may affect the domain or the Seller's interests, Atom may require the Seller's prior approval before you put the domain to any such use, and may decline or condition the use at its discretion. You should confirm whether a proposed use of this type is approved before relying on it.

In the event that a domain becomes subject to a third-party claim — such as a proceeding under the Uniform Domain Name Dispute Resolution Policy (UDRP), Uniform Rapid Suspension (URS), a court proceeding, or a registrar or registry action (each, a "Claim") — the following terms will apply.

You must notify Atom promptly, and no later than 2 business days after receipt, of any Claim, notice, complaint, or demand relating to the domain, and provide a complete copy of any such communication. Failure to provide timely notice is a material breach of these terms.

During the rental period, the Seller (if known and available) has the right, but not the obligation, to control the defense of any Claim. You may participate in the defense and are responsible for all costs and expenses of defending any Claim arising from your use of the domain, unless otherwise agreed in writing.

During the rental period, you may not agree to any settlement that provides for the transfer, cancellation, or encumbrance of the domain without Atom’s prior written consent, which will not be unreasonably withheld.

While the domain is held in an Atom-managed account, Atom may take any actions reasonably necessary to comply with registrar or registry requirements or to preserve the domain, including locking the domain, modifying or suspending DNS, restricting access, or communicating with registrars, registries, or dispute providers.

Atom cannot guarantee the outcome of any Claim, and a domain may be suspended, transferred, cancelled, or otherwise affected by circumstances outside Atom's control. If this happens, Atom will review the situation in good faith and work with you and the Seller toward a fair resolution. Payments already made remain non-refundable, and in any such event Atom's total liability will not exceed the amounts actually received by Atom from you.

A “Renter-Caused Claim” is any Claim arising from your use of the domain, including hosted content, redirection, or advertising. If you fail to timely notify Atom of a Claim, fail to respond within applicable deadlines, or fail to participate in the defense, Atom may immediately suspend your access and take any actions reasonably necessary to preserve the domain. Related costs may be charged to you or offset against amounts paid or payable.

If a Renter-Caused Claim is asserted, or if Atom reasonably determines your use has materially increased the risk of such a Claim, Atom may terminate the rental on written notice. Upon such termination your usage rights end, your prior payments are non-refundable, and you remain obligated for amounts accrued prior to termination.

You agree to indemnify, defend, and hold harmless Atom and the Seller, and their affiliates, officers, directors, employees, and agents, from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from any Renter-Caused Claim or your breach of these terms.

Atom may take any actions necessary to investigate, prevent, or address suspected fraud, abuse, or violation of these terms, including suspending or delaying the rental, withholding or reversing payments to the extent permitted by law, terminating the rental, and taking legal action or cooperating with law enforcement. You agree to cooperate with any such investigation.

You agree not to directly or indirectly attempt to circumvent Atom by contacting the Seller outside the platform to complete a rental, purchase, or any related transaction without Atom’s involvement. Any such attempt is a material breach of these terms.

The domain is provided “AS IS” and “AS AVAILABLE.” Atom and the Seller disclaim all warranties, whether express, implied, or statutory, including warranties of title (except as expressly stated), non-infringement, merchantability, and fitness for a particular purpose. Atom makes no representation regarding the legal availability, trademark status, traffic, revenue, or performance of the domain.

You acknowledge that you have conducted your own independent investigation and due diligence with respect to the domain, and that Atom does not provide legal, financial, or valuation advice.

To the maximum extent permitted by law, Atom is not liable for any indirect, incidental, special, consequential, or punitive damages. Atom’s total liability will not exceed the amounts actually received by Atom from you.

You agree to cooperate fully in connection with the rental and any subsequent transfer of the domain, including providing accurate registrar information and timely responding to confirmations.

Notices to Atom must be in writing and sent to Squadhelp LLC, Attn: Legal Department, 2000 Center Drive, Suite East B216, Hoffman Estates, Illinois 60192, USA, and by email to legal@atom.com. A user account is not required to receive effective notice.

These terms incorporate the Atom Terms of Service (available at atom.com/legal/terms) with respect to disclaimers, limitation of liability, indemnification, dispute resolution and arbitration, and general platform terms. Where these terms conflict with the Atom Terms of Service, these terms control as to their subject matter. Governing law, venue, and dispute resolution follow the Atom Terms of Service; to the extent not applicable, these terms are governed by the laws of the State of Illinois.

Any violation of the Domain Registrar’s Terms of Service may result in the loss of this domain.
